The majority on the Constitutional Court considered that the euthanasia law supports the \u201cfree, informed, and conscious decision as to how and when to die\u201d in cases of terminal illnesses or severe disability.<\/p>\n

The court\u2019s ruling rejected \u201cconsidering solely and in isolation the fundamental right to life.\u201d<\/p>\n

The resolution states that the constitutional concept of life as a fundamental or legal right to be protected is not \u201cdisconnected from the will of the person who holds that right\u201d nor is it \u201cindifferent to their decisions on how and when to die.\u201d<\/p>\n

The court also said that the government has \u201cthe duty to provide the necessary means to enable the help of third parties\u201d and thus administer euthanasia.<\/p>\n

In addition, the court stated that palliative care \u201cdoes not constitute an alternative in all situations of suffering\u201d entailed in the law.<\/p>\n

Two judges dissented from the ruling: Enrique Arnaldo and Concepci\u00f3n Espejel, who pointed out that the decision exceeds \u201cthe scope and limits of the jurisdiction that corresponds to the Court.\u201d<\/p>\n<\/p><\/div>\n
